New Proposal Seeks to Protect Trees in Environmentally – Sensitive Areas

Cavan Monaghan is exploring the implementation of a new by-law to regulate tree removal insensitive areas.

It’s a topic that has been discussed from time to time since 2011 but to date has yet to find traction. Past investigations found policies in other jurisdictions were complex and potentially unenforceable, but recently some municipalities have been directed to update their regulations to include more stringent penalties for non-compliance. The proposed by-law seeks to protect trees on private property by walking the line between protecting significant trees in environmentally-sensitive areas and regulating large-scale tree removal while avoiding interference in normal rural and agricultural activities.

The by-law promotes the use of Forest Management Plans to support the healthy growth of woodlands and applies only to healthy clusters of five or more trees of at least15 cm (6 inches) in diameter. The regulation would also regulate clear cutting in forested areas, defined as the removal of a portion of a woodland in excess of 0.2 hectares (0.5acres). Clear cutting activities would require a public meeting and support of Council to proceed. The regulation also protects significant community trees which have been designated as such by Council.

Not all trees are protected under this proposal. No approvals are required for the removal of trees with a diameter of less than 15 cm; are located outside a designated naturally sensitive area; are dead, diseased or hazardous; are on the invasive species list; are being removed as part of normal farm practice; are part of a Forest Management Plan; are included in an approved building permit; or are cut for firewood.

The proposal has proactive and reactive components. Under the by-law, all Planning Act applications that include tree removal would be subject to review to identify options to avoid tree cutting, and tree protection and replacement plans might form part of the permit requirements. There is also the reaction side where investigations into tree cutting activities is initiated in response to complaints.
